Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DriveKit mobile application, website, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

1) Who we are

The Service is provided by Choie Products(“DriveKit,” “we,” “us,” or “our”).

2) Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian.

5) User content and vehicle data

You may submit content such as vehicle details (e.g., make/model), mileage, fuel logs, service records, notes, images, and related data (“User Content”).

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate, improve, and provide the Service.

You represent you have the rights to submit the User Content and that it does not violate applicable laws or third-party rights.

7) Notifications and reminders

The Service may send reminders (push notifications, emails, or in-app alerts) based on schedules, mileage, or settings.

You are responsible for verifying maintenance intervals and safety-critical information with your vehicle manufacturer, service provider, and/or owner's manual. We do not guarantee reminders will be delivered or received on time.

8) Third-party services

The Service may integrate with third-party services (e.g., analytics, crash reporting, authentication providers, or cloud services). Your use of third-party services may be governed by their terms and privacy policies. We are not responsible for third-party services.

The Service, including its software, designs, logos, and content (excluding User Content), is owned by DriveKit and its licensors and is protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

If you provide suggestions, ideas, or feedback, you grant us the right to use it without restriction or compensation.

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read the Privacy Policy.

13) Disclaimer of warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate or preserved without loss.

14) Limitation of liability

To the maximum extent permitted by law, DriveKit and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim (or $50 if you paid nothing), unless required otherwise by law.

Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless DriveKit from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

16) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

Upon termination, the license to use the Service ends. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive.

17) Changes to the Service or Terms

We may update the Service and these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice or updated “Last updated” date). Continued use of the Service after the effective date means you accept the updated Terms.

18) Governing law and dispute resolution

These Terms are governed by the laws of Italy, excluding conflict-of-law rules.

Any dispute arising from these Terms or the Service will be brought in the courts located in Milan, Italy, unless applicable law requires otherwise.
